hi peeps.

I'm just confused right now and thinking if i still go in MY for the job. i need your advice Sad nag sign nako contract with MY agency and yun nga may clause na if i di nag show up sa 1st day i would pay 1month salary damages. I recently did the medical test with the 3rd party agent in ph that is working with my agent for poea and medical test. i failed in one test in med and they want me to go redo the test again. the big catch here is one of my previously applied job here in ph is offering me for a job with quite the same salary vs MY job (if you less the monthly expense in MY vs in PH i need not to pay rent..etc and of course MY less tax i guess?) now I'm contemplating what to do because i only got a week to decide given by PH company if ill get the job or not. they even offered me a work from home incentive just to seal the deal. i'm thinking of a lot of consequences of course with regards with MY agency. need your inputs.

Hi there,

Naku mahirap nga ung pag sitwasyon mong yan, nakasign ka na kc ng contract sa Agency ng Malaysia? ang tanung po may Agency din ba cla sa pinas na pinagsignan mo ng contract mo? You have 3 options, kaso walang option na pabor sau, hehehe.

1.) Pay the fees, bonding and expenses na nagastos nila sa application mo, try to negotiate with them, baka maawa sila at babaan ung fee. Alukin mo cla ng offer like hahanap ka ng replacement mo para sa Malaysia. ( sana nakapag negotiate ka sa kumukuha sau na company mo sa PH na tulungan ka nila to settle this fees).

2.) Ipagpatuloy mo ung work mo sa malaysia, although mapapalayu ka sa family mo, at un nga may mga expenses ka sa house + food and mas lower ung tax mo, mukang halos same lang, talo ka lang kc mahohomesick ka.

3.) Mag run-away ka sa agency, although ang consequences dito is pwede ka nilang demanda, or next time na mag-abroad ka meron ka ng run-away case hehehe, tapos un magbabayad ka parin ng certain fees, pero atleast diba later na.


Please take note na nagsign ka na ng contract, whatever will be your decision dapat panindigan mo. Mas maganda po pag ung desisyon is mangagaling talaga sa inyo, atleast wala kang sisisihin kung anu man ang mangyari. Ilang beses narin pong nangyari sakin, pagkasign ko ng contract, may mga nag offer sakin times 2 of my current salary. Pero laging first decision po ang pinapairal ko. Syempre meron naman tayung ibat ibang paniniwala.

Good luck to you, wala pong mali kung anu man ang desisyon mo pero kung anu man ang mangyari, always believe na kaya mo pinili un kasi dun ka masaya, hahaha.

Sa post mo sabi mo nag fail yung medical test mo. Why not use that as a reason para hindi mo ituloy yung contract? Kung pwede yun hehe... Meron bang nakalagay sa kontrata mo na kahit medical reason ang pag end mo ng contract eh magbabayad ka pa rin?

I totally agree with Slacker. If you're heart desires to stay at home (Philippines) , you can use that as your basis on not proceeding sa application mo. Which is a valid reason , kasi di ka nmn makakapagproceed sa next processing mo once you are failed sa Medical Exam mo.

Usually, wala nmn na silang magagawa if you are not really FIT TO WORK (based lang po yan sa Medical Result). - may mga cases kasi sa mga clinic sa atin na kahit fit to work ka, nagiging unfit due to money reason para mas kumita sila from you..hehehe..

Just try to check things carefully, pero to be honest with you..kung ako nasa kalagayan mo- i will compute my NET pay and compare.If my net pay is almost the same.. I would rather stay in the Philippines..  Yan lang po ang masasabi about your case.. Smiley

hay, tama! nakalimutan ko un, uu nga pala pwde mong gamitin ung medical as a reason hahaha, nawala sa isip ko un.

Agency palang naman pala .wala pa yan, ang kontrata mo sa agancy pa lang, on the process ka palang ng pag apply sa MY. hangat wala ka pang EP, pwede ka pang mag back-out, wala makakapigil sa yo. Free kang tumangi at wag ituloy ang application mo...Free ito wala kang babayaran..

Kung parehas lang sweldo sa PH and MY. I suggest, stay ka ng Pinas. Unless gusto mo talagang lumayo at umalis ng Pilipinas. IMHO..   Wink

depende po sa nakasulat sa contrata, hindi po purke contrata ng agency or ng company pwde pong mag backout. Hindi rin po basis ang pagback out na "HINDI PA NAMAN NA APPLY UNG EP", Please take note na wala po kayung laban sa contrata lalo nat pumirma kau, ung pagpirma nyo sa contrata means nag agree kau kung anu man ang nakasulat sa contrata. Kaya kapag umabot kau sa legal settlement talo po kayu. 

if im not mistaken, meron ding nakasulat sa contrata na may penalty, once na magbackout kau, it always depends on the CONTRACT, different agency or company, different contract syempre. Pero kung sa tingin nyo wala namang nakasulat na consequences or bad effect sa pag quit nyo sa contrata of course pwde un. Kaya depende talaga sa content ng contrata.

Isipin nyo nalang na kayu ung nasa agency or ung nasa company, anu mafefeel nyo na magbaback out nalang sia ng ganun ganun, and to think na marami kang nireject na applicants para sa position na yun.


Sana maging responsible po tayu sa mga pinipirmahan natin, always read the contract po. Napaka powerful ng papel na ito.

Initial stage pa lang si TS, baka nga sya pa nagbayad ng medical nya eh...so walang kaso, pwede pang mag back-out...!

Pag may Employment Pass ka at nag back-out ka bigla...Dito may malaking problema ka...

Wala namang problema kung mag back out ka, naintindihan naman natin un, of course may karapatang kang mag back out or ituloy ung application mo, pero hindi nangangahulugang VOID na ang CONTRATA or wala ng silbi ung CONTRATA specially kapag nakapirma ka na.


sabi nyo po Free kang tumangi at wag ituloy ang application mo...Free ito wala kang babayaran.., what do you mean po walang kabayaran? e nakasulat sa contrata po na pag hindi nagpakita ng 1st day is 1 month salary damage ang babayaran nia? tapos nakapirma narin sia? tanung ko lang po? ang BASIS nyo po ba para valid ang contract is EMPLOYMENT PASS? base po kasi sa statement nyo, parang walang kwenta ung CONTRATA kung walang EMPLOYMENT PASS? Ibig sabihin po ba since wala siang EMPLOYMENT PASS hindi sia pwdeng pagbayarin ng PENALTY? kahit naka state sa contrata na may PENALTY pa?

just back out...the reason we go out because our salary is not sufficient in PH. so if you will just earn as much as you are earning in PH what's the point? I dont know maybe you have a personal reason but in general, MAS MASARAP TUMIRA/magtrabaho SA PH compare sa abroad...

my personal view...
