Hi Peeps,

Bago lang ako dito and TYIA for the useful information you will provide for the decision making i need to do. heheh.

I have a JO on-hand and will be on a 1yr contract of with a one "Consulting Firm in KL" deployed with one of their client.

I still haven't signed the JO since medyo tricky yung some of the CLAUSE with their contract.

1) 1YR BOND which is understandable. 1YR you cannot resigned or you will pay with 1MONTH salary - This is quite FAIR right?

2) This is quite the weird one - If the employee GOT terminated by the company in less than a year you will pay with 1MONTH salary. - HUH? seryoso ba ton? tinanggal ka na ikaw pa magbabayad? okay lang ba ton? parang pabor na pabor sa kanila a...

ano po ba mga dapat ipalagay pa dapat sa written contract? pa include if ever...black and white lang dap at...para walang gulangan...

Yes, most of consulting firm have this in their JO clause

If the employee GOT terminated by the company in less than a year you will pay with 1MONTH salary>>  This kinda absurd and unfair...

Please brought up your concerns at this point if the clause in JO made you hesitate to sign. It should be black and white, kasi pag may nangyari at wla sa contract yun dehado ka talaga.

thanks for the quick reply. medyo di ako makapag decide kasi because of that. pano if sabihin nila poor performance ako in less than a year or they just want you out because tapos na project eh parang layoff. ako pa magbabayad..saklap naman nun!

hi po... weird nga po yan, pero wala naman cgurung ganyang contrata. what i mean is baka typo error or misunderstanding?


HINDI KAYA sila ang magbabayad sayu ng 1month Salary? Baka ganun po un, pag tinerminate ka nila na hnd pa tapos contrata mo bibigyan ka nila ng 1 month sahod....

talk to them already and rerevise nila yung contract. ano ba tax rate for 7K MYR? ilang % kakaltas sa sweldo po...salamat...sana ok naman tao kasama if ever...im scared...i dont have anyone hehe

7K ? wow - ang laki ang offer ah.. hehehe..

usually po ang first 6 month (182 days) tax  is 26 % , you can check it sa http://forum.mypinoylah.com/employment/28-tax-is-it-true/..

Depende po yan sa company arrangement po.. Different company have different way of tax deduction pero at the end iisa lang nmn din po ang outcome... =)

Yung iba po kasi 14% for the whole year..ung tira refund mo na lang.. some will deduct the specific percentage sa salary mo...ung tipong wala kang 26% obligation for first 6months...

sabi sakin "Initially first 6 months tax deductions will be 15% for foreign employees with in the period of 6 month) on your basic salary and from the 7th month it will be as per the normal (As per local tax regulations) process" - eh bat ganun po ser? ano na yun pang 7th month? ang alam ko lang kasi 32% sa pinas hahaha one time bigtime na walang pinatutunguang tax eh haha

Baka the other way around yan. usually tax is 26% for first 6 mos. then rest is pro rated. Pero dpnde pa rin sa company nyo ano ang arrangement.

according to my HR, kaya daw kc na imbento yang 26% tax na yan for the first 6 months is to protect the companies, sa mga taong nag RUN-AWAY. Opo, tama po kayu, para sa mga tumatakas na tao yan, kasi kawawa naman ung company after spending a lot of money and time sa tao para applyan ng permit e bigla nalang tatakbu, so usually hindi na irerefund daw yan sa company kapag tumakbo ung tao, of course ung tao wala siang makukuha since tumkbo nga sia hihihih. but of course 25% is not mandatory, depende pa rin daw sa company yan, kaya ung ibang company, hindi na nila iniimplement ito, kasi naawa din cla tao, masyadong malaki nga naman.

Just in case your company wants to implement this, isipin mo nalang na savings nyo yan. Regardin nerdchuck case mukang mabait ung company mo kc binawasan nia ginawa niang 15% nalang insteaed of 26%, but dont you worry, you can still get 8% to 9% of your tax at the end of the year, or after 6 months.
pagtapos nga nun pupunta ka na sa 6%-7%, lagyan natin ng computation para mas maenganyo ka magbayad ng tax hehehe.


assuming salary is 7000.00
15%  = 1050

so 1050 * 6 = 6300.00

tax refund is 8 to 9 % = 3780


after 6 months meron ka pong 3780, hehehe, convert natin sa peso todays rate is 1

Malaysian ringgit = 13.9862123 Philippine pesos

i round off ko na ng 14, kc after 6 months 14 na yan hahahha

3780 * 14 = 52,920


so ALL in ALL po meron po kayung tumataginting na 52,920.

wow salamat sa mathematically inspired answer hehe...ok pala magbayad ng tax sa MY. kasi nagiging SAVINGS na di mo namamalayan. kasi burden un tax sa PH eh haha (no offense sa mga patriotic sa PH - malaki lang po tlaga ang TAX sobra at di nararamdaman)

anyways mukhang grab ko na nga opportunity and bahala na si Lord pano mamuhay ng solo for the first time hehehe.

mga sir at mam ask ko lang po. ok lang ba na magkaiba ang "DESIGNATION" a.k.a. Job Role from contract against contract to be process sa poea daw. kasi sabi sakin may quota daw sa poea for "IT Consultant" designation. naguluhan ako. is that ok? they change my role to MST Consultant ba un.
